VolJet Terms & Conditions
DEFINITIONS
Parties - The two parties of this agreement are the "Customer" and "VolJet, LLC" (VolJet).
Customer/Charterer - The Individual, Customer or Entity requesting the service.
VolJet - The Company providing the grouping service.
Jet Operator/Charter Operator/Supplier - The Company providing the transport services to the Customer.
VolJet enables the formation of groups to travel to common destinations once the group is formed and "committed." These operators exercise full operational control of the charter flights at all times and the contract for carriage is entered between the client group participants and operator directly.
VolJet® does not own nor operate aircraft. VolJet® arranges groups, on behalf of its client group preferences, and presents group demand to FAA Part 135 certificated operators who have achieved the industry's highest standards.
Status PENDING is indicated when the group has not reached the required number of people for confirmation of the group or an Operator has not claimed the group. The Operator may claim a group at any amount
of passengers in the group.
Status COMMITTED is indicated when the required number of passengers in a group is met and an Operator has claimed the group.
VolJet enables access and grouping of people with third party operators supplying the transport. All operator terms and conditions will apply.
VolJet enables access and bookings to commercial airlines with a third party supplier. All airline terms and conditions will apply.
Upon acceptance of these TERMS AND CONDITIONS, the Customer confers upon VolJet to act on their behalf as their agent for the grouping service.
GENERAL
VolJet does not own or operate aircraft. VolJet arranges groups of people with similar travel destinations, exclusively with FAA Part 135 certified Jet Operators. VolJet enables access and bookings to
commercial airlines with a third party supplier.
- The Customer will comply with all baggage guidelines.
- All flights contracted with Jet Operators are non-smoking.
- Passengers must be 18 years of age or older to travel alone.
- Additional technical stops may be required for fuel, customs or other operational reasons.
Any passenger name change request may be submitted to VolJet and the Jet Operator no less than 72 hours (3 days) before departure and will be subject to verification and approval by the government
regulatory agency. If a passenger name change is attempted within 72 hours (3 days) prior to departure, passage will not be guaranteed for any ticket that has been transferred from its original purchaser.
- Charterer MUST inform VolJet and Jet Operator prior to trip confirmation of ANY animal Charterer desires to bring on the flight. Failure to do so will be considered a flight cancellation and the appropriate fees will be charged.
- Any cleaning fees for damages or stains (i.e., pets, red wine) requiring professional cleaning or repair will be billed to the customer at cost.
- Firearms and hazardous materials including explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials, (examples include paints, light fluid,
fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals) cannot be carried aboard the aircraft.
PRICES AND PAYMENT TERMS
For all transactions, VolJet charges a $100/person processing fee, except for in the case of charter flights, which is $100 per flight. Processing and broker fees will be charged upon booking in order to
reserve your space. Final payment will be processed upon the Group being claimed by an Operator. Commercial airline options are not subject to the $100 processing fee. For commercial airline options,
payment is due in full at the time of booking.
For "Charter and Save" transactions, the person who initiates the charter flight, hereby called the "Charterer", pays the processing and broker fees upon booking. Final payment will be
processed upon the Group being claimed by an Operator. (For Groups that have been previously claimed by an Operator, full payment will be processed at the time of booking.) Should people elect to join the group, the Charterer will be able to view the adjusted fare for their flight as people join. The final
refund to the Charterer’s credit card will be issued on the day of departure if people elect to join their group. At no time will the Charterer’s cost equal zero.
For private jet flights, standard catering appropriate to your itinerary will be provided. Customers with special dietary needs are welcome to bring their own food aboard. Any additional food options and
special needs may be available but need to be requested at the time of booking through the Jet Operator for an additional cost. Customers must arrange and pay for their special requests directly with the
Jet Operator. VolJet takes no responsibility for customer ordered catering or other special requests or services. All jet operator terms and conditions apply.
Pre-payment by credit card is required in order to arrange and confirm the groupings.
VolJet protects all personal and sensitive financial information using end-to-end encryption and encrypting data at rest, allowing for information to be stored and transmitted securely.
Prices include fuel surcharges, international handling, and landing fees. Fares do not include additional expenses such as deicing, additional hangar charges, special catering, cleaning for wear and tear, cleaning for pet on board,
or other special services and requests. Additional expenses incurred will be charged directly to the card on file after the completion of the flight by the Jet Operator per their Terms and Conditions.
CANCELLATION POLICY
General
If you fail to cancel or are a "no-show" at departure, you will incur a 100% penalty including the $100/person (or $100 for charter flights) processing fee and the transaction fee based upon the flight cost with no refund or credit.
Any passenger name change request may be submitted to VolJet and the Jet Operator no less than 72 hours (3 days) before departure and will be subject to verification and approval by the government regulatory agency. If a passenger name
change is attempted within 72 hours (3 days) prior to departure, passage will not be guaranteed for any ticket that has been transferred from its original purchaser.
For all transactions, VolJet charges a $100/person (or $100 for charter flights) processing fee and transaction fee that will only be refunded should VolJet be unable to arrange a flight on behalf of a closed group or be unable to
close the group. Commercial airline options are not subject to the $100 processing fee.
All credits will only be applied to future VolJet groups and will not be refunded.
Cancellation credits cannot be applied toward the $100 per person or per Group booking fees.
VolJet facilitates the grouping for private jet charter and all Jet Operator terms and conditions will apply.
VolJet facilitates the purchase of commercial airline tickets and all airline terms and conditions will apply.
Form a Group:
Prior to 30 days of your scheduled departure, cancellations will be allowed a full refund less the $100/person processing fee if the status of your group is pending.
Between 30 days and greater than 7 days of departure, if your flight is pending and no one has joined your group, you may receive a full refund less the $100/person processing fee.
If VolJet cannot commit the group within 72 hours of departure and options offered are not suitable, then all clients in the group will receive a full refund, including the $100/person processing fee and transaction fee.
Once the VolJet group is committed, the following cancellations terms will apply:
- If greater than 7 days prior to your scheduled departure, you will have a 100% credit applied on a future VolJet arranged group, less the $100/person processing fee.
- Cancellations within 7 days of your scheduled departure will incur a 100% penalty including the $100/person processing fee with no credit.
Join a Group:
Prior to 30 days of your scheduled departure, cancellations will be allowed a full refund less the $100/person processing fee if the status of your group is pending.
Between 30 days and greater than 7 days of departure, you will have a 100% credit applied to a future VolJet arranged group, less the $100/person processing fee.
If VolJet cannot commit the group within 72 hours of departure and options offered are not suitable, then all clients in the group will receive a full refund, including the $100/person processing fee.
Once the VolJet group is committed, the following cancellations terms will apply:
- If greater than 7 days prior to your scheduled departure, you will have a 100% credit applied on a future VolJet arranged group, less the $100/person processing fee.
- Cancellations within 7 days of your scheduled departure will incur a 100% penalty including the $100/person processing fee with no credit.
Charter and Save (Charter your Own and Open to Share):
If you have opened your charter to share and no one has joined your charter, then the Charter your Own rules apply.
If you charter and others have joined your group then the following cancellation terms apply:
- Cancellations made more than 7 days prior to the scheduled departure will forfeit 50% of the final fare at departure and receive a 50% credit of the final fare at departure, less the $100
processing fee. The credit can be applied to a future VolJet arranged group.
- Cancellations within 7 days of the scheduled departure will incur a 100% penalty, including the $100 processing fee, with no credit.
Charter your Own:
If you charter, the following cancellation terms apply:
- If greater than 7 days prior to your scheduled departure, you will have a 100% refund, less the $100 processing fee.
- Cancellations within 7 days of scheduled departure will incur a 100% penalty including the $100 processing fee.
Itinerary and Booking Changes:
All customer booking and itinerary changes to groups will be considered cancellations and will be subject to above cancellation terms and conditions. Some flight detail changes may be considered to be
new groups and will be subject to the $100/person (or $100 for charter groups) processing fee upon booking.
PASSENGER IDENTIFICATION
A government-approved form of photo identification is required for all passengers for all flights. For international flights, correct passenger international travel documentation is required.
Customer is liable for any fines, penalties, cancellation penalties or other costs arising from incorrectly documented passengers or non-approval of passenger(s) against TSA and/or Jet Operator no-fly lists.
RESPONSIBILITY AND PARTIAL COMPLETION OF FLIGHTS
VolJet shall not be liable for any injury, damage, loss, expense, special or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of
any other company or person engaged in conveying the passenger or carrying out the arrangements for this trip or by accident, delay, flight schedule, change, cancellation, sickness, weather,
strikes, war, quarantine or any similar cause. VolJet liability shall in any case be limited to the amount paid to us, and any claim shall be adjudicated in and governed by the laws of the state of DELAWARE. VolJet is not liable for additional expenses incurred for replacement transportation in the case of mechanicals.
Every attempt will be made to meet the departure and arrival commitments but weather and/or availability of landing slots may require last minute itinerary changes. If unforeseen events occur,
contact contracted Jet Operator directly.
VolJet is a third-party intermediary for customers, airlines, airplane operators, and similar third parties providing travel related services ("Suppliers"). Suppliers are independent
and do not act for or on behalf of VolJet are not employees of VolJet. Suppliers will have their own terms and conditions for the services
they provide and you agree to abide by those terms and conditions set forth in any and all documents provided by that Supplier. By utilizing the services represented by this itinerary, you agree to
the foregoing and also agree that neither VolJet nor any of their respective officers, directors, employees, and representatives shall be or become liable for any loss, cost, expense, injury, accident,
or damage to person or property resulting directly or indirectly from (i) the acts or omissions of Suppliers, including, but not limited to, delays or cancellation of services, cessation of operations,
breakdown in machinery or equipment, or changes in itineraries or schedules; and/or (ii) acts of God, dangers incident to the sea, fires, acts of government or other authorities, wars, acts of terrorism,
civil unrest, strikes, riots, thefts, pilferage, epidemics, quarantines, other diseases, climatic aberrations, or from any other cause beyond VolJet’s control.
Charterer shall indemnify and hold harmless VolJet from and against all third party claims, allegations, demands, liabilities, fines, losses, damages, costs and expenses (including, without limitation,
reasonable fees and expenses of attorneys and any amounts paid in settlement) arising out of or related to: (i) the breach by Charterer of any of its material obligations under these Terms and Conditions
or (ii) the negligence, gross negligence, bad faith, intentional or willful misconduct of Charterer, its employees or other representatives.
